Anti Spam Policy

The following discloses our permission-based marketing practices for digiWebMail. This policy in no way supersedes, replaces or complements the privacy policies of our clients.

• Anti Spam Policy

Our clients are encouraged to make use of Sanders Design’s digiWebMail facility to send personalized communications to prospective customers. However, clients must not use this facility to post unsolicited commercial email or unsolicited bulk email – a process commonly known as ‘spamming’ or expediting large amounts of SPAM.

Sanders Design adopts a robust approach towards any client that abuses our applications for spamming purposes, in particular if intending to advertise illicit or illegal activities.

Any client found using our digiWebMail product for spamming purposes will have their account closed.

It is worth remembering that:

1. Spamming is not a good way to advertise Services/products.
2. Spamming is against the law.
3. digiWebMail services are only made available to clients who use an opt-in mailing list.

‘SPAM’ is:

Unsolicited commercial email or email sent to a recipient who would not reasonably expect to receive email from the sender.

‘SPAM’ is not:

Email dispatched:

1. To recipients with a previously established relationship with the sender.
2. That includes a mechanism for recipients to easily remove themselves from the mailing list.
3. To inform customers about product or service support/news/developments.

At Sanders Design we understand that getting the balance right between providing a useful level of product information to your customers, and over-loading your customer base with excessive and invasive marketing material, is vital for your communications strategy to succeed.

We therefore encourage companies to respect their customers’ time and attention: it is sensible to restrict the frequency of mailings to individual email addresses and, if possible, also a good idea to personalise correspondence with existing customers as much as possible.

digiWebMail regulations:

Sanders Design’s digiWebMail service is available to clients subject to the following regulations:

1. License Agreement – mailing list administrators are required to agree to a licence agreement stipulating that all members on their mailing list have an established relationship with the list owner.
2. Mandatory Unsubscribe Instructions – all messages sent via digiWebMail must include easily followed instructions informing recipients how their email addresses may be removed from the mailing list.
3. Account Termination for Abusers – Sanders Design reserves the right to terminate digiWebMail accounts found to have been used to post unsolicited email – with no refund.
4. Customer Data Sharing Obligations – in the event that we receive a complaint about unsolicited email emanating from a client’s digiWebMail system, we will require that client to reveal the external source of their customer data.
5. Mandatory Third Party Compliance – clients that obtain external lists for use with digiWebMail facilities must ensure that third parties, when relevant, also fully comply with our policies. Third party violations of digiWebMail regulatory agreements are thus considered violations by the clients themselves, and subject to the same punitive action.

Reporting misuse of digiWebMail services:

Recipients of unsolicited email – SPAM – sent via digiWebMail (or claiming to be sent via digiWebMail) are encouraged to report it directly to us:

1. Our clients are required to adopt a stringent anti-SPAM policy. If you have received unsolicited email from one of our clients, please report it at abuse@digiWebMail.
2. Remember to attach a copy of the offending email message. This is necessary for us to be able to prosecute instances of digiWebMail abuse. Unless you request otherwise, we will not respond to your email.
